UNIQUE has no duty to inquire into the accuracy, sufficiency, or completeness of any documents or information and in no instance shall be charged with information that Customer fails to give in writing. UNIQUE may rely on all documents and information furnished to UNIQUE. If Customer fails to perform any obligation, UNIQUE may use its judgment in connection with the goods.

(b) As an additional requirement, any suit to recover on a claim against UNIQUE must be commenced within one (1) year after the date of delivery or release of the goods, the date when the goods should have been delivered or released, or the date when any other loss, damage, expense, or delay first arose.
